Terms of Service

1What Castn does

Castn generates short-form content — image carousels and video — from briefs you provide, and can schedule and publish that content to social accounts you connect. You direct what is made and when it is published. We provide the tooling.

2Eligibility and accounts

You must be at least 18 and able to form a binding contract. You are responsible for the accuracy of your account details, for keeping your credentials secure, and for everything done under your account. Tell us promptly at support@castn.ai if you suspect unauthorised access.

3Your content, and who owns what

You keep ownership of everything you upload and, as between you and us, of the content Castn generates from your inputs. We claim no ownership of your posts.

You grant us a limited licence to host, process, transmit and display your content solely to operate the service — generating from it, storing it, showing it back to you, and delivering it to platforms you have connected. That licence ends when you delete the content or close your account, except for backups pending routine deletion.

We do not use your content or your character photographs to train models, and we do not use them to serve any other customer.

4Rights in faces, products and source material

This is the clause most likely to matter to you. You represent and warrant that:

• You own, or have written permission to use, every photograph, product image, brand asset and piece of source material you upload.
• Where you upload photographs of a person to build a character, you are that person or you have their explicit, informed permission to create and publish synthetic images and video of their likeness.
• You will not use Castn to create a likeness of any person who has not agreed to it, including public figures, and will not use it to impersonate anyone.
• Where you analyse or take structural inspiration from an existing post, the content you publish is your own and does not reproduce another creator's footage, images, audio or text.

Castn stores the structure of a format — slide count, roles, framing, pacing — not the source media. You remain responsible for ensuring what you publish is yours to publish.

5AI-generated content and disclosure

Output is synthetic. It may be inaccurate, may not depict real events, and should not be presented as documentary. When Castn publishes on your behalf we flag the content to the platform as AI-generated so it can be labelled accordingly. You must not remove, defeat or misrepresent that labelling, and you must comply with each platform's rules on synthetic media.

You are the publisher of what you post. You are responsible for its accuracy, for any claims it makes about a product, and for compliance with advertising and consumer-protection law in your market — including disclosing paid partnerships and promotional content where required.

6Connected platforms and publishing

Connecting a social account authorises Castn to act on that account strictly as you instruct. We publish only content you created in Castn, and only when you schedule it or confirm a post. You can disconnect at any time in the app, or revoke access from within the platform's own settings.

Your use of each connected platform remains governed by that platform's own terms. For TikTok that includes its Terms of Service, Community Guidelines, Branded Content Policy and Music Usage Confirmation. Where those rules conflict with anything you want to do in Castn, the platform's rules win. We are not affiliated with, endorsed by, or acting as an agent of TikTok.

Platforms change, deprecate and rate-limit their APIs. We cannot guarantee that publishing will always succeed, that a scheduled post will go out at an exact moment, or that a connection will remain available.

7TikTok-specific terms

Where you connect a TikTok account, the following apply in addition to the rest of these terms:

• You must comply with TikTok's Terms of Service, Community Guidelines, Branded Content Policy and Music Usage Confirmation. Where they conflict with these terms in respect of what you publish, TikTok's rules prevail.
• You are the author and publisher of everything posted to your account through Castn.
• You must disclose promotional and paid-partnership content using TikTok's own commercial-content controls where it applies.
• You must not use Castn to evade TikTok's spam, automation, integrity or authenticity rules, or to operate accounts in a coordinated inauthentic way.
• You must not use Castn to publish content that would breach TikTok's policies on synthetic media, impersonation or misleading likeness.
• TikTok may suspend, restrict or remove your account or content at its discretion. That is between you and TikTok, and we are not liable for it.

Doffy Labs Ltd is an independent developer. Castn is not affiliated with, sponsored by, or endorsed by TikTok, and we do not act as TikTok's agent. TikTok is a third-party beneficiary of this section and may enforce it directly against you.

If our access to TikTok's APIs is suspended, restricted or withdrawn, the related features may stop working. We will tell you if that happens, but it is outside our control.

8Acceptable use

You must not use Castn to create, schedule or publish content that:

• impersonates a person, brand or organisation, or misleads about who is speaking;
• depicts a real person without their permission, or places words in their mouth;
• is sexual, violent, hateful, harassing, or targets a protected characteristic;
• promotes self-harm, illegal goods or services, or fraud;
• makes health, financial or product claims you cannot substantiate;
• infringes copyright, trade marks, likeness or other rights;
• is designed to inflate engagement artificially, or to evade a platform's spam, integrity or automation rules.

You also must not resell or sublicense the service, attempt to extract our models or prompts, probe or circumvent our security, or use the service to build a competing product.

Operating multiple accounts is permitted; using Castn to run coordinated inauthentic behaviour across them is not.

9Copyright and other rights complaints

If you believe content published through Castn infringes your copyright, trade mark, or your rights in your own likeness, email legal@castn.ai with: what was infringed, where the content is, enough detail for us to find it, your contact details, a statement that you believe the use is unauthorised, and a statement that your report is accurate and that you are the rights holder or authorised to act for them.

We investigate every report, remove or disable infringing material where the claim is made out, and terminate the accounts of repeat infringers. If you believe your content was removed in error you can reply to the same address with a counter-notice.

Content already published to TikTok must also be reported to TikTok, since we cannot remove posts from your account once they are live there.

10Plans, billing and credits

Paid plans are billed in advance on a recurring basis until cancelled. Generation consumes credits as described on the pricing page; credits do not carry over unless stated. You can cancel at any time and will keep access until the end of the paid period. Except where the law requires otherwise, payments already made are non-refundable. We will give reasonable notice before changing prices.

11Feedback

If you send us suggestions we may use them without restriction or obligation to you. We will not identify you as the source without your permission.

12Preview and experimental features

Features marked beta, preview or experimental are provided without warranty, may change or be withdrawn without notice, and may have lower reliability. Do not rely on them for anything critical.

13Availability

We aim to keep Castn running but do not promise uninterrupted service. We may change, suspend or discontinue features, and we depend on third-party providers for generation, storage and publishing whose availability we do not control.

14Suspension and termination

You may stop using the service and delete your account at any time. We may suspend or terminate access if you breach these terms, if your use puts our platform relationships at risk, if required by law, or for prolonged non-payment. Where circumstances allow we will warn you first. On termination your licence to use Castn ends, and we delete your data as set out in the Privacy Policy.

15Disclaimers

The service is provided "as is". To the fullest extent permitted by law we disclaim implied warranties of merchantability, fitness for a particular purpose and non-infringement. We do not warrant that generated output will be accurate, original, suitable for your purpose, or that it will perform on any platform.

16Liability

Nothing here limits liability for death or personal injury caused by negligence, for fraud, or for anything else that cannot be limited by law. Subject to that, we are not liable for indirect or consequential loss, lost profits, lost revenue, lost data, or loss arising from a platform suspending or removing your account or content. Our total liability in any twelve-month period is limited to the amount you paid us in that period.

17Indemnity

You will indemnify us against claims arising from content you publish through Castn, from your breach of these terms, and in particular from any claim that you lacked the rights or permissions described in section 4.

18Changes to these terms

We may update these terms. If a change is material we will give notice in the app or by email before it takes effect. Continuing to use Castn after that means you accept the updated terms.

19General

Entire agreement. These terms and the Privacy Policy are the whole agreement between us on this subject and replace anything said before.

Severability. If a clause is unenforceable, the rest still stands and the clause is read as narrowly as needed to make it valid.

No waiver. If we do not enforce something immediately, we have not given up the right to enforce it later.

Assignment. You may not transfer your rights under these terms without our consent. We may assign them to a successor in a merger, acquisition or sale of assets, on notice to you.

Force majeure. Neither party is liable for delay or failure caused by events outside its reasonable control, including outages at infrastructure or platform providers.

Notices. We will contact you at your account email. You can reach us at the addresses in section 21.

Export and sanctions. You confirm you are not located in, and will not use Castn from, a country subject to comprehensive sanctions, and that you are not on a restricted-party list.

20Governing law

These terms are governed by the laws of England and Wales, and its courts have exclusive jurisdiction. If you are a consumer, you keep the protections of the mandatory law of your country of residence.
